Seller Warranty Policy

Warranty obligations a seller owes for the products it sells.

1. Purpose and scope#

1.1 This Seller Warranty Policy ("Policy") sets out the Seller's warranty obligations for its Items on the Fawran marketplace ("Platform"). It forms part of, and is incorporated into, the Seller Agreement, and operates together with the buyer-facing Warranty Policy. Capitalised terms have the meaning in the Seller Agreement.

1.2 Because the Seller is the seller of record, the Seller is responsible for providing and honouring warranties for its Items, in addition to Buyers' non-waivable rights under the Consumer Protection Law No. 7 of 2017 and the Civil Code No. 43 of 1976 (latent defects).

2. Warranty obligations#

2.1 The Seller shall ensure that each Item carries the warranty stated in its Listing and any warranty required by law, and shall accurately disclose the warranty type, duration, coverage, and claim process. Where an Item ordinarily carries a warranty and none is stated, the minimum period in the buyer-facing Warranty Policy applies.

2.2 The Seller shall provide one of, or both, as applicable: a Manufacturer/Brand Warranty (serviced by the manufacturer, brand, or their authorised service centres) or a Seller Warranty (provided and serviced by the Seller). The Seller is responsible for ensuring stated warranties are genuine and honoured.

3. Seller Warranty service standards#

3.1 Where a Seller Warranty applies, the Seller shall: receive and assess claims promptly; repair, replace, or refund as required; and complete repairs within a reasonable period and, in any event, endeavour to repair or replace within fourteen (14) business days of receiving the Item, subject to parts availability and the nature of the fault. Where repair and replacement are not possible, the Seller shall provide a refund or equivalent remedy consistent with the buyer-facing policy and the law.

4. Dead on Arrival#

4.1 The Seller shall prioritise eligible Dead-on-Arrival cases reported within the timeframe in the buyer-facing Warranty Policy, providing replacement or refund without undue delay.

5. Manufacturer/Brand Warranty#

5.1 Where a Manufacturer/Brand Warranty applies, the Seller shall ensure the warranty is valid and accurately represented, provide the Buyer with the information needed to claim, and remain responsible to the Buyer and Fawran where the represented warranty is not honoured or was misrepresented.

6. Costs and logistics#

6.1 For valid warranty claims within the warranty period, assessment, repair, replacement, and return shipping are at no cost to the Buyer; the Seller bears these costs (or ensures the manufacturer does). Where, on assessment, an Item is not covered (for example, due to misuse or external damage), the Seller shall communicate any applicable charge before proceeding, consistent with the buyer-facing policy.

7. Exclusions#

7.1 Commercial-warranty exclusions (such as accident, misuse, liquid damage, unauthorised repair, and normal wear) may apply as stated in the Listing and the buyer-facing Warranty Policy, but do not limit Buyers' statutory rights where an Item is defective, not as described, or unfit for purpose.

8. Records and cooperation#

8.1 The Seller shall maintain warranty records, honour valid claims in good faith, cooperate with Fawran's buyer-protection processes, and provide evidence where a claim is disputed. Fawran may make a final determination consistent with the buyer-facing policy and mandatory law to protect Buyers, with financial responsibility resting on the Seller where the claim is valid.

9. Funding and recovery#

9.1 Where Fawran provides a remedy to a Buyer on the Seller's behalf under a warranty obligation (including refunds), Fawran may deduct and recover the corresponding amount from the Seller in accordance with the Payout Policy and the Commission & Fee Policies.

10. Consumer-protection interaction#

10.1 This Policy does not exclude or limit Buyers' rights under the Consumer Protection Law No. 7 of 2017, the Civil Code No. 43 of 1976, or other applicable law. Where a statutory remedy is more favourable to the Buyer, it applies, and the Seller bears the corresponding responsibility.

11. Amendments, electronic acceptance, governing law, and disputes#

11.1 This Policy may be amended in accordance with the Seller Agreement; acceptance is electronic under the Electronic Transactions Law No. 15 of 2015; this Policy is governed by the laws of the Hashemite Kingdom of Jordan, with disputes resolved in accordance with the Seller Agreement.
