Intellectual Property Complaints Policy

How a rights owner reports infringement on Fawran, and how the other side can respond.

1. Purpose and scope#

1.1 This policy explains how to report an infringement of an intellectual property right on the Fawran platform, how the other side responds, and what we do.

1.2 It covers infringement of:

  • trade marks — using a mark, or something similar to one, without right;
  • copyright — copying images, text, designs or video without licence;
  • patents and industrial designs;
  • and also product images and descriptions copied from someone else.

1.3 A suspicion that a product is counterfeit is better routed — if you are a buyer — through the Authenticity and Counterfeit-Product Complaints Policy. If you are the rights owner, this document is your route.

2. Who may complain#

  • the rights owner;
  • or an authorised agent acting under a mandate.

3. What a report must contain#

So that we can act, your report should include:

2Identification of the right allegedly infringed: the trade mark or patent registration number, or a description of the protected work
3Evidence of the right: the registration certificate or its equivalent
4Identification of the listings concerned, by link or identifier for each — not a general description
5A statement of how it infringes, specifically
6The mandate, if you are an agent
7A good-faith statement that the use complained of is not authorised by the rights owner, its agent, or the law
8A statement that the report is accurate and that you are authorised to submit it

A report that does not identify listings by their link cannot be acted upon. We do not search for listings on a complainant's behalf, and we do not remove an entire product category on the strength of a general description.

4. Where to send it#

To the legal contact address shown in the “Operator and contact details” section at the foot of this document, with “Intellectual property complaint” in the subject line.

5.1 We do not adjudicate ownership of the right or the merits of the claim. We are not a court; we act on what the evidence shows us, preserving both parties' right to go to court.

6. ★ The Seller's right of reply#

6.1 Removal is not a final judgment.

6.2 A Seller whose listing was removed may submit a counter-notice setting out the basis of its right, attaching whatever it has:

  • a licence or permission from the rights owner;
  • a purchase invoice from an authorised distributor;
  • evidence that the use is lawful (such as exhaustion of rights or legitimate descriptive use);
  • or evidence that the report concerns a different listing.

6.3 We reconsider the removal in the light of the counter-notice, and may restore the listing if the report proves unfounded.

6.4 We inform the complainant of the counter-notice and of what we decided.

7. Bad-faith reports and abuse#

7.1 Submitting a report the complainant knows to be untrue — for example to remove a competitor's listings — is serious abuse.

7.2 It may lead to: refusal of their later reports, notification of the affected party, and cooperation with any legal action that party takes.

7.3 A bad-faith complainant may incur liability towards the injured party before the courts.

8. Repeat infringement#

8.1 We take graduated action against a Seller found to infringe repeatedly, up to termination of its account.

8.2 The detail is in the Seller Agreement and the Seller Code of Conduct published in the Seller section of the Legal Center.

9. Legal footing#

9.1 Article 4(d) of the Consumer Protection Law No. (7) of 2017 obliges the supplier to provide products that do not infringe intellectual property rights.

9.2 Jordanian legislation in force protects intellectual property rights of every kind, and a rights owner may go to the competent court regardless of any action we take.

9.3 Our action is administrative, not judicial: it stops a listing on our platform. It does not determine ownership of a right and does not award compensation.

10. Buyer content#

10.1 Where the infringement is in a review or an image posted by a buyer, the same procedures apply.

10.2 The buyer content rules are in the Product Reviews, Ratings and User Content Policy.

11. Fawran's own marks#

11.1 The Fawran name, logo and visual identity are ours.

11.2 They may not be used without prior written permission, or in a way that suggests a relationship, sponsorship or endorsement that does not exist.

11.3 If you see someone impersonating Fawran, report it under the Customer Support and Official Contact Policy.
