Prohibited & Restricted Products Policy

1. Purpose and scope#

1.1 This Prohibited & Restricted Products Policy ("Policy") identifies products and content that may not be sold ("Prohibited Items") or that may be sold only subject to conditions and approvals ("Restricted Items") on the Fawran marketplace ("Platform"). It forms part of, and is incorporated into, the Seller Agreement, and applies to all Sellers. Capitalised terms have the meaning in the Seller Agreement.

1.2 The Seller is solely responsible for ensuring that everything it lists or sells is lawful and compliant. Listing or selling a Prohibited Item, or a Restricted Item without meeting its conditions, is a material breach.

2. General rule#

2.1 Sellers may only list and sell Items that: are lawful to sell in Jordan and in the Buyer's delivery location; the Seller is authorised to sell; are genuine, safe, and accurately described; and comply with all applicable laws, this Policy, the Product Listing Policy, and the Seller Code of Conduct.

3. Prohibited Items (non-exhaustive)#

3.1 The following may not be listed or sold: (a) illegal goods and anything whose sale, possession, or import is prohibited under Jordanian law; (b) counterfeit, replica, or infringing goods, and goods bearing unauthorised trademarks or copyrighted content; (c) stolen goods, and goods with removed, altered, or falsified serial numbers or identifiers; (d) weapons, firearms, ammunition, explosives, and their parts, and prohibited bladed or dangerous weapons; (e) illegal drugs, narcotics, controlled substances, and related paraphernalia; (f) prescription medicines and unregistered or unauthorised pharmaceuticals and medical devices; (g) hazardous, radioactive, or unlawfully traded materials, and items that violate dangerous-goods rules; (h) human remains, organs, and bodily fluids; (i) protected wildlife, endangered species, and products derived from them (e.g., ivory) contrary to law; (j) obscene or unlawful adult/pornographic content, and any child-exploitative material; (k) materials promoting hatred, violence, terrorism, or discrimination, and unlawful political or extremist content; (l) currency, financial instruments, and items facilitating fraud, including counterfeit currency and skimming devices; (m) hacking, surveillance, or circumvention devices and software whose primary purpose is unlawful; (n) goods subject to sanctions or unlawful to trade; and (o) any other Item Fawran designates as prohibited or that is unlawful or unsafe.

4. Restricted Items (conditional)#

4.1 The following may be listed only where the Seller meets all applicable legal requirements and any Fawran conditions, holds all required licences and approvals, and provides required disclosures and warnings; Fawran may require pre-approval, documentation, category authorisation, or restrict eligibility: (a) food, beverages, and consumables, subject to food-safety, labelling, expiry, and storage requirements; (b) cosmetics, supplements, and personal-care products, subject to registration and labelling requirements; (c) non-prescription medicines, medical devices, and health products permitted for sale, subject to authorisation; (d) alcohol and tobacco-related products, where lawful, subject to age and regulatory restrictions; (e) electrical and electronic products, batteries, and items requiring conformity, safety, or type approval; (f) chemicals, flammables, aerosols, and other regulated dangerous goods subject to handling and shipping rules; (g) children's products and toys, subject to safety standards; (h) age-restricted Items, requiring age verification at sale and/or delivery; (i) plants, seeds, and agricultural products, subject to import and phytosanitary rules; (j) jewellery and precious metals, subject to hallmarking and authenticity requirements; (k) regulated electronics such as drones, radio transmitters, and similar devices requiring approval; and (l) any other category Fawran designates as restricted.

5. Seller responsibilities#

5.1 The Seller shall: verify the legality and compliance of each Item before listing; hold and maintain all licences, registrations, and approvals; provide accurate, required information, warnings, and disclosures; comply with import, customs, and product-safety requirements; and immediately remove and stop selling any Item that becomes prohibited, unsafe, recalled, or non-compliant, and notify Fawran.

6. Fawran's rights and enforcement#

6.1 Fawran may, at any time and without prior notice where appropriate: refuse, remove, or suppress Listings; restrict or revoke category or model eligibility; require documentation or pre-approval; quarantine, return, or dispose of non-compliant inventory (including FBF inventory, subject to the Commission & Fee Policy — FBF); withhold or reserve funds; suspend or terminate the Seller; and report to authorities and rights holders.

6.2 The Seller is liable for all consequences of listing or selling Prohibited or non-compliant Restricted Items, including refunds, removal, disposal, fines, claims, and Fawran's losses, and shall indemnify Fawran accordingly.

7. Consumer protection and safety#

7.1 This Policy supports compliance with the Consumer Protection Law No. 7 of 2017 and product-safety requirements. Nothing in this Policy limits Buyers' statutory rights or the Seller's responsibility for the safety and legality of its Items.

8. Amendments, electronic acceptance, governing law, and disputes#

8.1 Fawran may update this Policy, including the lists of Prohibited and Restricted Items, at any time in accordance with the Seller Agreement; changes are effective on publication or as stated, given the safety and legal importance of this Policy. Acceptance is electronic under the Electronic Transactions Law No. 15 of 2015. This Policy is governed by the laws of the Hashemite Kingdom of Jordan, with disputes resolved in accordance with the Seller Agreement.
